TERMS & CONDITIONS (2026 / 2027)

NOMADIC OFF-ROAD LLC (hereinafter referred to as “the Company”) accepts clients and any accompanying 4x4 passengers (hereinafter referred to collectively as “the Client”) subject to the following Terms and Conditions.

1. BOOKING AND PAYMENTS

1.1 The Client agrees to pay 30% of the total tour price at the time of booking to reserve a seat.
1.2 The tour seat is considered reserved and confirmed once the down payment has been received.
1.3 If the tour is scheduled to start within sixteen (16) weeks or less at the time of booking, full payment (100%) is required.
1.4 All bank charges related to international transfers must be fully covered by the Client.
1.5 The remaining balance of the total tour cost must reach the Company’s account no later than ten (10) weeks before the scheduled tour start date.
1.6 Full bank account details will be sent together with the invoice at the time of booking.
1.7 All payments must be made in Euros (€).
1.8 Security Deposit
Unless the Client purchases the Bike Protection Plan (see below), each Client must pay a security deposit of €400 before the start of the tour to cover potential damages to the motorcycle or loss/damage of any equipment provided.
This deposit will be fully refunded immediately after the tour, provided no damage or loss has occurred.

1.9 Bike Protection Plan
The Company offers an in-house damage protection plan for motorcycles. For an additional €190 (non-refundable), all motorcycle damages up to €1,000 are covered. If the Client purchases the Bike Protection Plan, no security deposit is required.

2. CANCELLATION, LICENSES & INTERNATIONAL VISA

All Clients are strongly advised to purchase travel insurance at the time of booking to cover cancellation or unforeseen circumstances.

The following refund policy applies to payments received:

  • 12 weeks or more before departure: 90% refund

  • 8–11 weeks before departure: 30% refund

  • 5–7 weeks before departure: 20% refund

  • 0–5 weeks before departure: no refund

Down payments are non-refundable for cancellations received less than six (6) months before the tour.

In cases of force majeure, the Company may issue a credit for payments made, which can be used for another tour within 24 months of the original tour date.

2.1 All cancellations must be submitted in writing via email.
2.2 The Client confirms that they hold a valid motorcycle driving license and possess sufficient experience riding an enduro motorcycle.
2.3 Only the Client recognized and accepted by the Company may operate the motorcycle.
2.4 Any fines, penalties, or legal costs resulting from traffic violations or other offenses caused by the Client during the tour are the sole responsibility of the Client, unless caused by the Company.
2.5 If the Client fails to arrive at the specified time and date, the Company shall not be liable for any refund or repeat tour.
2.6 If a Client arrives late in Ulaanbaatar and misses the tour departure, additional charges of approximately €400 may apply to arrange private transport (Client and motorcycle) to rejoin the group.
2.7 If a Client or the entire group decides to terminate the tour early or deviate from the original itinerary, additional transport costs to return the motorcycles to Ulaanbaatar may apply. These costs will not exceed €500.
2.8 The Client is responsible for arranging their entry visa for Mongolia in advance. The recommended timeframe is 6–8 weeks before travel. If the Client fails to obtain the required visa or is denied entry into Mongolia, the Company is not obliged to refund any tour payments.

3. RESPONSIBLE DRIVING, LIABILITY & HEALTH

3.1 If damage occurs as a result of motorcycle stunts or reckless riding, the Client will be fully responsible for all repair costs.
3.2 The Client acknowledges and accepts the risks involved in motorcycle travel and off-road riding, including but not limited to:

  • mountainous or uneven terrain

  • fallen trees, branches, rocks, or roots

  • steep slopes or unstable ground

  • rivers, lakes, canyons, snow or ice

  • extreme weather conditions

  • wildlife encounters

  • sun exposure, insect bites, dehydration, fatigue, or altitude effects

3.3 Mongolia has a zero-tolerance policy regarding alcohol and driving. Clients must not consume excessive alcohol the night before the first tour day while still in Ulaanbaatar. Police checks are frequent and motorcycles may be confiscated if a rider tests positive.

3.4 The Client confirms that they do not suffer from any medical condition that could endanger themselves or others during the tour. If unsure, medical advice must be obtained before participation.

3.5 The motorcycle assigned to the Client remains their responsibility until returned at the end of the tour.
Local people must not be allowed to sit on or ride the motorcycle.

3.6 All riding gear and equipment provided by the Company remains the responsibility of the Client. Lost items may be deducted from the security deposit.

3.7 Clients may only start and operate the motorcycle when instructed or authorized by the tour leader.

3.8 Clients must not ride independently or separate from the group without permission from the tour leader, particularly in remote areas such as the Gobi Desert, where navigation risks are significant.

4. CLIENT ACKNOWLEDGEMENT

The Client understands and agrees that:

a) They are responsible for their own travel and medical insurance, including repatriation coverage.

b) Participation in the tour is entirely at their own risk.

c) The Company, its staff, agents, or partners are not liable for personal injury, loss, damage, delay, or inconvenience, whether caused by Company actions or circumstances beyond its control (including strikes, mechanical failures, or weather conditions).

d) Due to the nature of the tour, the Company cannot accept responsibility for damage or loss to personal belongings.

e) If the Client voluntarily leaves the tour early, or is required to leave by a Company representative for safety or conduct reasons, all Company liability ceases immediately. Any additional expenses are the responsibility of the Client.

5. TOUR CHANGES

The Company reserves the right to modify tour dates, routes, or accommodations when necessary due to weather conditions, logistical issues, or safety considerations.

If a tour is cancelled by the Company, all payments received will be refunded in full.

All distances and itinerary details are approximate and intended as guidance only.

6. JURISDICTION

Any dispute arising between the Client and the Company shall be governed by and resolved under the laws and jurisdiction of Mongolia.

7. AMENDMENTS

Nomadic Off-Road LLC reserves the right to amend or modify these Terms and Conditions at any time.
Reasonable efforts will be made to notify Clients of any changes where applicable.
